Commission on Arbitration and ADR
The Commission on Arbitration and ADR is ICC’s unique think tank and rule making body in the field of international dispute resolution, helping to achieve these aims.
Together with the ICC Court and the ICC Centre for ADR, the commission also drafts and revises ICC’s range of rules for dispute resolution, comprising:
- ICC Rules of Arbitration,
- Rules of ICC as Appointing Authority,
- ICC Mediation Rules,
- ICC Dispute Board Rules,
- ICC Expert Rules, and
- ICC DOCDEX Rules
In its research capacity, the commission proposes new policies in the interest of efficient and cost-effective dispute resolution and provides useful tools for the conduct of dispute resolution.
Often carrying out specific work in smaller task forces, under the mandate of the commission chair, it also produces practical reports and guidelines on legal, procedural and practical aspects of dispute resolution, which are published regularly in free booklets and electronic format, in the ICC Bulletin or on the ICC website.
The experts behind our evolving services
The commission is made up of approximately 1,000 members from more than 92 countries comprising lawyers, in-house counsel, arbitrators, mediators, law professors and experts in various dispute resolution fields.
Members are appointed to the commission by an ICC regional office (known as national committees) in their respective countries.
Members meet twice yearly to discuss and approve proposed rules, reports and guidelines.
Task Force members are also appointed by national committees and are usually chaired by two members who guide the form and substance of the work.
Task Force missions include the study of an aspect of arbitration or sector where it is used, resulting in recommendations, guidance and/or a standard arbitration clause for such disputes.
A commission steering committee, comprising the Chair and the Vice-Chair along with other representatives of ICC Dispute Resolution Services, also meets twice a year to discuss and agree upon the overall action plan for the commission, including the proposal of task forces.
