Law, sanctions, cargo risks and payments
One day with ICC Russia for your transaction
About the event
Today, an international contract is no longer merely a formal document recording the parties’ arrangements. It has become a full-fledged tool for strategic management of a cross-border transaction.

It is the contract that now sets out:
  • mechanisms for overcoming sanctions-related restrictions;
  • allocation of currency and logistics risks;
  • selection of a “safe” jurisdiction;
  • ensuring actual performance of obligations in a changing global environment.

A single incorrectly drafted contractual provision may affect the future of the entire transaction.
Discussion of practical approaches to structuring international contracts, identification of typical mistakes and exchange of experience make it possible to develop solutions that ensure transaction resilience and predictability of performance even in a high-risk environment.

Round tables
1. Digital contract vs classical contract
Moderator: Arseny Topadze, Counsel, arbitrator, advocate — data protection and digital regulation, BGP Litigation.
We will discuss where the boundary of trust in electronic documents lies today, how eBLs and digital formats work in real transactions, and who bears the risks if a bank, counterparty or court does not accept “digital”.

2. Incoterms in the new geography of trade
Moderator: Stepan Sultanov, Partner, Head of International Commercial Arbitration Practice, KIAP Attorneys at Law.
We will discuss how supply chains have changed, why the formal allocation of risks increasingly diverges from the factual situation, and who ultimately bears responsibility for cargo in complex logistics.

3. Delivery control: protection or excessive regulation
We will examine which delivery confirmation mechanisms actually work, what happens when “the system confirms, but the counterparty does not”, and how this affects transaction structures.
